## Purpose

1. Determine if there is probable cause to believe defendant committed a felony.
2. Probable cause level for bindover more than for arrest.

## Conduct of Preliminary Examination

1. Evidentiary proceeding
2. Defendant must be present
3. Witnesses sworn
4. On the record
5. Rules of evidence apply (except for hearsay)

## Def's Rights

1. Sequestration/Exclusion of witnesses
2. Cross-examinations and direct examinations of own witnesses

## Dismissal?

1. No PC finding > dismissal
2. If felony charged but no PC for felony > reduction of charge to misdemeanor
